Participant Waiver and Release
Assumption of Risk
The participant, and the participant’s parent(s) or legal guardian(s) if the participant is a minor (collectively, the “Participant”), acknowledge and understand that participation in ice hockey and any nine HOCKEY programs, practices, games, clinics, camps, training sessions, events, or related activities (the “Activities”) involves inherent and substantial risks.These risks include, but are not limited to, bodily injury, serious injury, concussion, illness, permanent disability, paralysis, death, and property damage. Risks may arise from physical contact with other participants, falls, collisions, equipment failure, ice and facility conditions, weather, transportation, and the actions or negligence of the Participant or others, including coaches, officials, volunteers, spectators, and other participants.Participant acknowledges that ice hockey is a contact sport with inherent dangers, that some risks may not be known or reasonably foreseeable, and that Participant knowingly and voluntarily assumes all such risks, whether known or unknown, foreseeable or unforeseeable.
Waiver and Release of Liability
To the fullest extent permitted by Minnesota law, Participant expressly waives, releases, and discharges nine HOCKEY and its officers, directors, employees, agents, volunteers, coaches, officials, contractors, sponsors, facility owners, licensors, and affiliates (collectively, the “Releasees”) from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to participation in the Activities.This release includes claims based on the negligence of the Releasees, including but not limited to negligent instruction, supervision, training, selection, facility maintenance, inspection, or failure to warn of dangerous conditions, except to the extent prohibited by Minnesota law.This waiver applies to claims for personal injury, property damage, and wrongful death.
Use of Facilities and Premises
Participant assumes all risks arising from the condition and use of ice rinks, locker rooms, training areas, parking areas, and related premises. Participant understands that ice and facility conditions may change rapidly and that the Releasees do not guarantee the safety of any facility or equipment.
Indemnification
To the fullest extent permitted by Minnesota law, Participant agrees to defend, indemnify, and hold harmless the Releasees from any and all claims, damages, liabilities, losses, costs, or expenses (including reasonable attorney fees) arising out of or related to:
Participant’s participation in the Activities Participant’s violation of nine HOCKEY rules or policies Claims brought by or on behalf of the Participant by third partiesThese obligations survive the completion of the Activities.
Parent or Legal Guardian Acknowledgment (Minors)
If the Participant is under 18 years of age, the parent or legal guardian acknowledges that they have read and understand this agreement, consent to the minor’s participation, and understand that Minnesota law may limit the enforceability of liability waivers for minors.The parent or legal guardian nevertheless agrees, to the fullest extent permitted by law, to assume all risks on behalf of the minor and to indemnify and hold harmless the Releasees from claims arising out of the minor’s participation.
Media Consent
Participant grants nine HOCKEY and its designees the irrevocable right to photograph, video record, and otherwise capture Participant’s likeness, image, voice, and performance during the Activities.Participant grants a worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable, and sublicensable license to use such media in any format or medium now known or later developed for lawful promotional, educational, or informational purposes, without compensation.
Payment and Registration Cancellation Insurance
ALL SALES ARE FINAL, except in the event nine HOCKEY cancels a program without the option to reschedule.
Insurance Disclosure
Participant understands that nine HOCKEY insurance policies may contain significant exclusions. For example, there is no liability coverage for claims brought by one participant against another participant.
Governing Law and Venue
This agreement shall be governed by and interpreted in accordance with the laws of the State of Minnesota, without regard to conflict-of-law principles. Any legal action arising out of or relating to this agreement or the Activities shall be brought exclusively in the state or federal courts located in Minnesota.
Severability and Survival
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. All waivers, releases, and indemnification obligations survive participation in the Activities.
Electronic Signature and Final Acknowledgment
By submitting registration electronically, Participant (and parent or legal guardian, if applicable) acknowledge that they have read, understood, and voluntarily agreed to be bound by this Waiver of Liability, Assumption of Risk, Release, Indemnification Agreement, Media Consent, and Payment Policy in its entirety.Participant understands that by agreeing to this document, they are giving up substantial legal rights.
